  • Participant/representative portals

3. Eligibility and Authorised Users

You may use our services if you:

  • Are at least 18 years old, or are a parent/guardian/NDIS plan nominee acting for a participant under 18 or without capacity.
  • Have legal authority to enter into agreements and provide personal or health information.
  • Use our platform only for lawful and appropriate purposes.

4. Your Account

When creating an account, you agree to:

  • Provide accurate and complete information.
  • Keep your login credentials secure.
  • Immediately notify us of any unauthorised access or breach.
  • Be responsible for all activities under your account, including actions by authorised representatives.

We may suspend or close your account if we believe there has been misuse or a breach of these Terms.

5. Acceptable Use

You must not:

  • Use our platform for unlawful, harmful, fraudulent, or abusive purposes.
  • Upload or transmit material that is defamatory, offensive, obscene, discriminatory, or otherwise inappropriate.
  • Attempt to hack, bypass security, or disrupt our systems or other users' access.
  • Introduce viruses, malware, or harmful code.
  • Access, copy, or use our systems, data, or content without permission.

We reserve the right to monitor platform usage for security, service quality, and compliance purposes.

6. Services and Availability

  • We will take reasonable steps to ensure continuous access but do not guarantee that the platform will be error-free or available at all times.
  • We may modify, suspend, or discontinue features or services without notice if necessary for maintenance, upgrades, or compliance.

7. Third-Party Services

Our platform may link to or integrate with third-party providers (e.g., hosting, analytics, secure messaging). We are not responsible for the content, performance, or policies of these third parties. You should review their terms and privacy policies before use.

8. Intellectual Property

All website content, software, designs, graphics, and trademarks are owned by or licensed to VITL CARE. You may not copy, reproduce, distribute, or create derivative works without our prior written consent, except as permitted by law.

You indemnify and hold harmless VITL CARE, our directors, employees, and contractors against claims, losses, damages, or costs arising from your breach of these Terms or unlawful use of our services.

13. Termination

We may suspend or terminate your account immediately if you breach these Terms or engage in conduct likely to cause harm to us, other users, or the NDIS community. You may close your account at any time by contacting us.

14. Changes to Terms

We may update these Terms from time to time. The updated Terms will be posted on our website with the "Effective date" above. Continued use of the services after changes take effect constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of South Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of South Australia.
